讲座摘要Abstract
本讲座将概括介绍英格兰和威尔士“儿童优先”原则的基本内容，及其在司法实践中的大致开展状况，聚焦青少年司法制度对有犯罪经历儿童的回应方式。二十一世纪初，青少年司法领域的学者和实务人员开始对由新工党政府颁布的标志着“新少年司法体系”成立的《犯罪与治安法案（1998）》及其附随后果产生了担忧。为防止因实施了越轨行为或轻微犯罪的儿童被“犯罪化”和被“标签化”，甚至被强制卷入司法程序，青少年司法领域的学者和实务人员共同发展出一个聚焦罪错儿童特殊处遇的新兴理论框架，即低龄犯罪青少年需要被考虑“儿童优先，罪犯次之”的司法对待理念。该理论的提出有助于将罪错儿童从正式的青少年司法程序中予以分离，是一种基于“个体优势”导向和特殊化干预措施的司法程序。这一理念和方法勃兴于威尔士，之后于2021年正式被英格兰和威尔士青少年司法委员会所采纳。在全面实施后，上述地区的罪错儿童被卷入正式青少年司法程序的比例显著下降，同时罪错儿童被监禁的比例也呈现明显下降趋势。基于这样的背景，本次讲座将围绕英格兰和威尔士针对儿童犯罪问题的新形势与担忧进行深入讨论。事实上，我们已经发现，2020年之后社会中“儿童贫困”“校园问题”“儿童犯罪诱因多元化”等现象的发生数量均呈现上升态势。所以，研讨将重点考虑这些态势可能是当前及未来“儿童优先”模式所面临的头号威胁。
